Voluntades anticipadas: desafíos éticos en el cuidado del paciente Diretivas antecipadas de vontade: desafios éticos no cuidado do paciente Advance healthcare directives are intended for the individual to personally express their will and preferences about healthcare and treatment ahead of time. This literature review aims to describe the concept and structure of advance directives and the ethical aspects involved in patient care. Using the keywords “Advance Healthcare Directive” AND “Ethical Implication” and its Spanish equivalents, five databases were accessed: ProQuest, Philosophy, (...) PubMed, Web of Science and Scielo. Publications were narrowed down to the 2010-2018 period. Thirty-one articles were obtained and read critically. Results of this review were grouped into the following categories: concept, structure, clinical situations in which advance directives apply, strengths and limitations, as well as the ethical aspects involved. End of life-related experiences in which a person loses their ability to make decisions and cannot express their wishes, so it is impossible to know their will, are more common nowadays. Most health workers are not appropriately trained in the preparation and application of advance directives, which becomes an opportunity to research and delve deeper into the subject. Advance directives are a tool that gives health workers reliable information on a patient’s values and wishes, so it is vital to train them to provide respectful quality care. Introduction: Traditionally, empathy has been studied from two main perspectives: the theory-theory approach and the simulation theory approach. These theories claim that social emotions are fundamentally constituted by mind states in the brain. In contrast, classical phenomenology and recent research based on enactive theories consider empathy as the basic process of contacting others’ emotional experiences through direct bodily perception and sensation. Objective: This study aims to enrich knowledge of the empathic experience of pain by using an experimental phenomenological method. Method: (...) Implementing an experimental paradigm used in affective neuroscience, we exposed 28 healthy adults to a video of sportspersons suffering physical accidents while practicing extreme sports. Immediately after watching the video, each participant underwent a phenomenological interview to gather data on embodied, multi-layered dimensions (bodily sensations, emotions, and motivations) and temporal aspects of empathic experience. We also performed quantitative analyses of the phenomenological categories. Results: Experiential access to the other person’s painful experience involves four main-themes. Bodily resonance: participants felt a multiplicity of bodily, affective, and kinesthetic sensations. Attentional focus: some participants centered their attention more on their own personal discomfort and sensations of rejection, while others on the pain and suffering experienced by the sportspersons. Kinesthetic motivation: some participants experienced the feeling in their bodies to avoid or escape from watching the video, while others experienced the need to help the sportspersons avoid suffering any injury while practicing extreme sports. Temporality of experience: participants witnessed temporal fluctuations in their experiences, bringing intensity changes in their bodily resonance, attentional focus, and kinesthetic motivation. Finally, two experiential structures were found: one structure is self-centered empathic experience, characterized by bodily resonance, attentional focus centered on the participant’s own experience of seeing the sportsperson suffering, and self-protective kinesthetic motivation; the other structure is other-centered empathic experience, characterized by bodily resonance, attentional focus centered on the sportsperson, and prosocial kinesthetic motivation to help them. Discussion: We show how phenomenological data may contribute to comprehending empathy for pain in social neuroscience. In addition, we address the phenomenological aspect of the enactive approach to the three dimensions of embodiment of human consciousness, especially the intersubjective dimension. Also, based on our results, we suggest an extension of the enactive theory for non-interactive social experience. (shrink)

La Constitución de 1988 fue nombrada como «ciudadana» porque reforzó los derechos civiles e introdujo derechos colectivos de pueblos indígenas y otros pueblos tradicionales, derechos colectivos sobre el medio ambiente y la cultura, además de derechos a la vivienda, a la salud, a la educación y de los consumidores. No fue fácil la implementación de esos derechos y el presente (...) trabajo analiza la aplicación de los derechos de los pueblos y de la naturaleza, dividiéndolos en tres periodos particulares. El primero, desde la promulgación de la Constitución, en 1988, hasta la elección de Lula da Silva y su posesión en 2003; periodo marcado por la aplicación de políticas neoliberales en contraposición con las normas constitucionales colectivas. El segundo periodo, representado por los gobiernos de Lula y de Dilma Rousseff, del 2003 hasta el 2016, cuando la presidenta es alejada para que asuma su vicepresidente; periodo marcado por un desarrollismo contradictorio con los derechos colectivos. The field of Philosophy of Sport has been developing in Anglo-Saxon scholarship since the 1960s and since then has achieved considerable consolidation. However, this is a progressing field in Latin American countries like Brazil. This paper aims to analyse the trajectory of the Philosophy of Sport in Brazil, presenting an overview of its development since the 1980s and some prospects that have been generated since the turn of the century. In conclusion, the article points out that the field of Philosophy (...) of Sport in Brazil is in the process of disciplinary consolidation, presenting a plurality of agents, institutions and theoretical approaches in its structure. RESUMEN: El presente artículo tiene por objetivo analizar la jurisprudencia de la Corte Interamericana de Derechos Humanos en materia de movilidad humana bajo la óptica de la doctrina filosófica del cosmopolitismo. A partir del desarrollo de las principales características de esta doctrina en relación a la migración (tensión entre nacionalidad, ciudadanía y derechos, así como las perspectivas actuales de solidaridad global), se sostendrá que la jurisprudencia interamericana tiende hacia al cosmopolitismo.ABSTRACT: The purpose of this article is to analyze the jurisprudence (...) of the Inter - American Court of Human Rights in the field of human mobility from the perspective of the philosophical doctrine of cosmopolitanism. This paper uses Avron’s algebraic semantics for the logic RMI to model some ideas in the philosophy of science. Avron’s relevant disjunctive structures are each partitioned into relevance domains. Each relevance domain is a boolean algebra. I employ this semantics to act as a formal framework to represent what Nancy Cartwright calls the “dappled world”. On the dappled world hypothesis, local scientific theories each represent restricted aspects and regions of the universe. I use relevance domains to represent the domains of (...) each of these local theories and I provide a formalisation of the salient relationships between so-called fundamental theories and local theories. I also examine ways in which the paraconsistent nature of RMI can be used to deal with inconsistencies within and between theories adopted by scientists. Our doxastic states are our belief-like states, and these include outright doxastic states and degreed doxastic states. The former include believing that p, having the opinion that p, thinking that p, being sure that p, being certain that p, and doubting that p. The latter include degrees of confidence, credences, and perhaps some phenomenal states. But we also have conviction (being convinced simpliciter that p) and degrees of conviction (being more or less convinced that p). This volume shows: how and (...) why all of the outright doxastic states mentioned above can be reduced to conviction thresholds; what degrees of conviction fundamentally are (degreed reliance-dispositions); why degrees of conviction are not credences; when suspending a belief is compatible with continuing to believe; and the surprising extent to which Kant endorsed the theory of conviction that emerges in this volume. Abstract:In this paper I focus on parasitic cases of exploitation in the case of UBI. I start by arguing that existing concepts of parasitic exploitation in the literature are over inclusive, since they label as cases of parasitic exploitation some cases that are not. Then I offer my own narrower framework of parasitic exploitation, which includes three conditions: built-in mechanisms, structural vulnerability and non-proportionality. I suggest that exploitation happens when agents misuse a system to obtain additional profit at the potential (...) expense of the weak party. This profit is additional compared to a counterfactual scenario in which the systemic vulnerability was not present. I argue that while some cases of parasitic exploitation may arise in the case of UBI, these cases are likely to be weak, and hence, absence of regulation of this system can be justified on the grounds that this would prevent stronger types of exploitation and domination.Key words: Universal Basic Income; parasitic exploitation; transactional exploitation; domination; misusing a system; free-rider. Negotiation and deliberation are two context types or genres of discourse widely studied in the argumentation literature. Within the pragma-dialectical framework, they have been characterised in terms of the conventions constraining the use of argumentative discourse in each of them. Thanks to these descriptions, it has become possible to analyse the arguers’ strategic manoeuvres and carry out more systematic, context-sensitive evaluations of argumentative discussions. However, one issue that still must be addressed in the pragma-dialectical theory—and other contextual approaches to argumentation—is (...) how to distinguish negotiation and deliberation in practice. In this paper, I seek to develop criteria that can help the analyst identify them in discourse. To this end, I characterise the felicity conditions of the superordinate speech acts defining and structuring deliberation and negotiation encounters. (shrink)

An argument is epistemically self-defeating when either the truth of an argument’s conclusion or belief in an argument’s conclusion defeats one’s justification to believe at least one of that argument’s premises. Some extant defenses of the evidentiary value of intuition have invoked considerations of epistemic self-defeat in their defense. I argue that there is one kind of argument against intuition, an unreliability argument, which, even if epistemically self-defeating, can still imply that we are not justified in thinking intuition has evidentiary (...) value. Lisa Tessman (2016: 164) recounts the case of a Jewish mother, running from Nazis, who faced a terrible choice. She could (a) drown her infant, or (b) accept the virtual certainty that her baby’s cries would doom the refugee group she was fleeing with. Given those options, (b) is worse. If the whole group is discovered, many will die, including the infant. Still, preemptively drowning a baby—indeed one’s own baby—is a terrible act. To make sense of cases like this, Tessman (...) turns to the concept of moral failure: an act that violates an important moral value such that the loss cannot be fully redeemed by gains elsewhere. I will argue that criminal justice needs a moral framework like Tessman’s. It needs to make sense of the fact that some options are genuinely better than others, without letting honorifics like ‘justice’ obscure the equally important fact the best available option might be terrible. More specifically, I will argue that when punishment involves prison, as it often does, it is a moral failure. It can be justified only in the sense that preemptively drowning an infant can be justified: like the fleeing mother, society might on some terrible occasions find itself with no better alternative. La teoría “coaseana” del derecho, y el Análisis Económico del Derecho en general, asumen implícitamente la veracidad de dos premisas comportamentales: la “exogeneidad de la preferencia” y la “independencia de la referencia”. Este artículo señala algunas objeciones a estas premisas, luego evidencia algunas implicaciones acerca de: cómo el AED –desde un punto de vista positivo– pronostica los comportamientos de las personas y los efectos de las normas jurídicas entendidas como incentivos, y cómo, –desde un punto de vista normativo– la teoría (...) económica sugiere las decisiones del juez o del legislador. El artículo además presenta los desafíos a los que se enfrenta el AED al aceptarse la premisa comportamental de que las personas valoran los derechos individuales, no en términos absolutos, sino en términos relativos, comparados con un punto de referencia. O presente texto não pretende ser um artigo analítico sobre Bourdieu mas um ensaio escrito da perspectiva de uma cientista política sobre as possibilidades abertas pela teoria desenvolvida pelo sociólogo francês para o estudo dos fenômenos da política. Com este propósito trabalharei com as noções de campo e capitais.

I explain why, from the perspective of knowledge-centric anti-luck epistemology, objective act consequentialist theories of ethics imply skepticism about the moral status of our prospective actions and also tend to be self-defeating, undermining the justification of consequentialist theories themselves. For according to knowledge-centric anti-luck epistemology there are modal anti-luck demands on both knowledge and justification, and it turns out that our beliefs about the moral status of our prospective actions are almost never able to satisfy these demands if objective act (...) consequentialism is true. This kind of applied moral skepticism introduces problematic limits on our ability to use objective act consequentialism’s explanatory power as evidence for its truth. This is, in part, a product of higher-order defeat as I explain in the final section. There is, however, a silver lining for objective act consequentialists. For there is at least one type of objective act consequentialism, prior existence consequentialism, that is poised to avoid at least some of the epistemic problems discussed in this paper. (shrink)

In modernity, the distinction between nature and artifice disappears, so that machines made by men become privileged models for the explanation of natural bodies, as can be observed in Bacon, Descartes, Hobbes, among others. This new relationship between nature and artifice is correlated with the mechanization and refutation of finality in nature, insofar as the adoption of mechanics as a model of nature’s explanation is associated to the rejection of the use of final causes in physics and to the conception (...) that bodies are devoid of immanent principles of movement or of any incorporeal principle that predisposes them to a process of change teleologically structured and oriented. Leibniz also conceives nature as artifice and organic bodies as automata, but his conception of natural bodies as artificial machines goes even further, to the point of characterizing the natural beings as those which carry the character of artificial rather than the artificial things themselves. However, unlike Bacon, Descartes, and Hobbes, Leibniz uses the analogy of nature as a machine and deepens it precisely to argue that nature is teleologically structured and that the difference between the machines made by men and the natural (divine) ones lies in the fact that while those have a purely extrinsic finality, these have an immanent finality inscribed in each of their parts to infinity. Typically seniors like others choose to avoid institutional care. However, when age-related infirmity requires it, they not only enter into the care of others, but they also do so as vulnerable members of society. As their frailty increases with age, so does their dependence on the professionals who care for them and on the enforcement of policies concerning their care. A qualitative case study involving seniors and their carers revealed that breaches of confidentiality, unprofessional behaviour and the non-enforcement of policy, (...) continue to hide the physical and emotional abuse perpetrated by nursing and other staff on vulnerable consumers. Professional ethics, including at a corporate level, enforcing policy, protecting whistleblowers and creating reporting mechanisms for aged care researchers, are amongst the recommendations arising from this study. This article has two tasks: to investigate the notions of space, time and causality in Schopenhauer’s theory of knowledge and, subsequently, to carry out a comparative study of the results obtained with the epistemological considerations between the first and second phase of Nietzsche’s thought. It is understood that conclusions concerning the world as representation had an echo in the first digressions of the author of The Birth of Tragedy on the conceptions of space, time and causality. However, the departures begin (...) to be perceived still in the first years of the 1870s. It is chosen to call the reflections on knowledge until On Truth and Lie in an Extra-Moral Sense, considering, besides the unsystematicity of the Nietzschean approaches, the maturation of the epistemological investigations in Human, All Too Human. It is discussed how the naturalistic aspects of the second phase of Nietzsche’s intellectual activity find implications in his conceptions of space, time and, above all, causality. It is emphasized, however, that it is not the intention of this work to argue that Nietzsche’s epistemology is originally derived from Schopenhauer or that it depends exclusively on the notions studied here. The distinction between propositional and doxastic justification has been of undisputed theoretical importance in a wide range of contemporary epistemological debates. Yet there are a host of intimately related issues that have rarely been discussed in connection with this distinction. For instance, the distinction not only applies to an individual’s beliefs, but also to group beliefs and to various other attitudes that both groups and individuals can take: credence, commitment, suspension, faith, and hope. Moreover, discussions of propositional and doxastic justification (...) have rarely focused on broader meta-epistemological issues, and yet meta-epistemological positions can have important implications for first-order views about this distinction. This volume addresses these and other issues by bringing together 16 essays that advance the state-of-the-art thinking on propositional and doxastic justification and explore how such thinking shapes and is shaped by a range of issues previously neglected in contemporary epistemology. The best arguments against gun control invoke moral rights—it might be good if there were fewer guns in circulation, but there is a moral right to own firearms. Rather than emphasizing the potential benefits of gun control, this paper meets the best arguments on their home turf. I argue that there simply is no moral right to keep guns on one’s person or in one’s residence. In fact, our moral rights support the mutual disarmament of citizens and police.

A theory of ersatz impossible worlds is developed to deal with the problem of counterpossible conditionals. Using only tools standardly in the toolbox of possible worlds theorists, it is shown that we can construct a model for counterpossibles. This model is a natural extension of Lewis's semantics for counterfactuals, but instead of using classical logic as its base, it uses the logic LP.

This article aims to offer a fresh analysis of two passages in the extensive necromancy episode in Lucan's Bellum Ciuile: the ritual to reanimate the dead soldier's corpse (6.667–73), and the surgical procedure Erichtho then proceeds to undertake (6.750–7), resembling the practice of a vivisection. The study will focus mostly on the strong connection of magic to medical traditions in antiquity, with a commentary on, and analysis of, these verses through the lenses of medical vocabulary, themes and motifs. It ultimately (...) concludes that Lucan was familiar with the language and characteristics of the medical tradition, enriched his report with them, and was playing with his audience's knowledge of the same. Rodrigo Olavarría’s notebooks, formulated as intimate diaries or notebooks, have a similar structure: a romantic breakup, a journey moved by grief and the reference to love as an excuse that fades among thousands of readings through which the artist’s identity and stance are revealed. He sacrifices himself for his exercise and he lives connected to the present of his daily life. However, he is capable of exceeding the isolation of writing where the self faces itself and attempts to cling to (...) the past, memory and the environment. His sacrifice turns him into a stoic, a slave, a fighter. Such archetypes, and his pilgrimage, arethe starting point of the political reading approach proposed in this article. (shrink)

Displays the current post-modernists who has influenced these areas and locates the various epistemological turns, such as the "linguistic turn" hermeneutics "and" pragmatic. Rescues the ontology as the basis for the sense of these reactions against these "turns" and seeks to demonstrate the theories of knowledge and historical and social perspectives that are in dispute. B) -> (A V for all xB). with x not free in A. Validity of EC requires an additional model condition involving the boolean difference of propositions. This Element looks at two projects that relate logic and information: the project of using logic to integrate, manipulate and interpret information and the proect of using the notion of information to provide interpretations of logical systems. The Element defines 'information' in a manner that includes misinformation and disinformation and uses this general concept of information to provide an interpretation of various paraconsistent and relevant logics. It also integrates these logics into contemporary theories of informational updating, probability theory and (rather (...) informally) some ideas from the theory of the complexity of proofs. Cet article étudie la manière dont cette revue a contribué à rendre (...) visible la parole des artistes entre 1962 et 1967, du moment de son émergence jusqu’au numéro d’été où figurent des textes incontournables pour le monde de l’art, tels que « Notes on Sculpture » de Robert Morris, « Towards the Development of an Air Terminal Site » de Robert Smithson, ou encore « Paragraphs on Conceptual Art » de Sol LeWitt. Despite a constitutional and oft-stated political commitment to an undefined notion of non-racialism, South Africans continue to operate in formal and informal ways with ‘race’ as the common-sense organizing principle of legal systems, ways of thinking, social identities, constructing arguments or closing debate, organizational and mobilizing strategies, policy development and execution, and interaction in daily life. This state of affairs is regrettable and dangerous, often questioned and rejected, but objections are waged and alternatives suggested against the tide of societal trends. (...) What the organizing principle of race thinking does is to close the mind to alternative possibilities – of thought, social practice and ways of living. Here I explore an overview of racialism as it permeates and shapes the life cycles of citizens from birth to death. I make an argument for a way of thinking that is necessarily utopian, as one of few options of escaping a social world made in the image of apartheid. (shrink)
